These terms govern your use of the website at creatus.ai, including the pages that present our AI tools. By using the website you agree to them. If you do not agree, please do not use the website. Our Privacy and Cookie Policy explains how we handle personal data.

1. Who we are

creatus.ai is operated by CREATUS.AI, based in the European Union. You can contact us at [email protected].

2. The website and the tools

creatus.ai presents AI tools and services, including image, video, voice and text tools, some of which are free to try. Some tools run on creatus.ai and others on separate apps or partner websites that we link to. When you use a tool on another website, that website's own terms and privacy policy apply as well.

Free tools are offered for evaluation and experimentation. We may change, limit or withdraw any tool or feature at any time, and we do not guarantee that any tool will be available, uninterrupted or free of errors.

3. Who may use the website

You must be at least 16 years old to use the website, and at least 18 to use any tool that works with the images, video or voices of real people. If you use the website on behalf of an organisation, you confirm that you are authorised to accept these terms for it.

4. Acceptable use

You agree not to use the website or any tool to:

• break any law or regulation, or help anyone else to do so;

• create, upload or share sexual or sexualised content involving a minor, or content that appears to involve a minor;

• create or share sexual or intimate imagery of a real person without that person's explicit consent;

• impersonate a real person, or use someone's face, likeness or voice without their permission, including to deceive, defraud, harass or defame;

• create content designed to mislead people about real events, or to spread disinformation;

• harass, threaten, bully or discriminate against anyone;

• infringe anyone's intellectual property, privacy or other rights;

• upload malware, or probe, scan, attack or try to gain unauthorised access to the website, our systems or anyone's data;

• scrape the website at a rate that burdens it, or get around any limit or security measure.

We may remove content, block access and report activity to the authorities where we believe these terms or the law have been broken.

5. Faces, voices and synthetic media

Some tools can change faces, clone voices or create realistic images and video. You may use them only with images, recordings and voices that you own or have clear permission to use, and only with the consent of every identifiable person shown or heard. Where the law requires it, including under the EU Artificial Intelligence Act, you must clearly disclose that content has been artificially generated or manipulated. You are responsible for how you use and share anything you create.

6. Your content

You keep all rights in the files, text and prompts you provide. You allow us to process them only as far as needed to run the tool you asked for and to keep the service secure. You confirm that you have the rights needed to provide them, and that providing them does not break these terms or the law.

7. AI output

AI output is generated automatically and can be inaccurate, incomplete, offensive or similar to other people's content. Review it before relying on it or sharing it. It is not professional advice. Subject to these terms and the law, you may use output that you create, but you are responsible for making sure your use does not infringe anyone's rights.

8. Our content

The website, including its text, design, graphics, logos and code, belongs to CREATUS.AI or its licensors and is protected by intellectual property law. You may view it and share links to it, but you may not copy, modify or republish it for commercial purposes without our written permission.

9. Links to other websites

The website links to other websites and services, including social networks and partner tools. We do not control them and are not responsible for their content, availability or practices.

10. No warranty

The website and the tools are provided "as is" and "as available". To the extent permitted by law, we give no warranties of any kind, express or implied, including that they will meet your needs, be accurate, or be free of errors or harmful components.

11. Limitation of liability

To the extent permitted by law, CREATUS.AI is not liable for any indirect or consequential loss, or for any loss of profits, data or goodwill, arising from your use of the website or the tools. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for intentional misconduct or gross negligence, or any other liability that cannot be limited by law.

12. Consumers

If you are a consumer, these terms do not affect the rights you have under the mandatory consumer protection laws of the country where you live.

13. Suspension

We may suspend or end your access to the website or any tool without notice if we reasonably believe you have broken these terms or the law, or to protect the website or other people.

14. Changes to these terms

We may update these terms from time to time. A new version applies from the date it is published on this page. If you keep using the website after that date, you accept the updated terms.

15. Governing law

These terms are governed by the laws of the European Union member state in which CREATUS.AI is established, together with applicable European Union law, and the courts of that member state have jurisdiction over any dispute. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and you keep the protection of its mandatory laws.
